Terms & Conditions - Real Estate Marketing
By submitting an order with us, you are agreeing that the home will be ready for photos to be taken at the requested/scheduled time and date of service. You also accept and acknowledge that A-Squared Digital Media charges a $75 service fee when we must return to a property for a reason out of our control. This includes, but is not limited to: construction, occupant not being ready, no key in lockbox/entry not provided, etc. Any same-day cancellations are also subject to a $50 cancellation fee. Please note that property square footage is subject to verification via County Tax Records.
Usage Rights
All photography and videography taken by A-Squared Digital Media and any affiliates is owned & copyrighted by A-Squared Digital Media. Right to use Photography/Media conveys once the invoice is paid in full to A-Squared Digital Media. Photos/Media may be used by the purchasing client to market and sell the subject property only. Photos/Media may be used in print marketing such as brochures/post cards/door hangers/newsletters/etc. Photos used in publications such as magazines (print/online) MUST be accompanied with the following photo credit: “Photo(s) by A-Squared Digital Media”. Photos and Media may never be distributed or sold to any third parties in any way. Usage rights must be purchased for every third party use. A-Squared Digital Media may use photos/media for marketing purposes of their own at any point in time unless a prior written agreement has been made.
Reshoots
For any reshoot required because of any reason outside the control of the Client, specifically including but not limited to acts of God, nature, war, terrorism, pandemic, civil disturbance, A-Squared Digital Media will charge no additional fee. If A-Squared Digital Media is at fault and a reshoot is necessary, A-Squared Digital Media will charge no additional fee so long as the request is made within 2 weeks of the original service date. After 2 weeks, Client is subject to reshoot fees. Client will be charged a fee for any reshoot required by Client in which A-Squared Digital Media was not at fault for the reason of the reshoot.
Cancellations
Client is responsible for payment of $50 for all orders canceled or rescheduled within 24 hours of the scheduled appointment. Unless otherwise agreed upon in writing, Client will be charged a $75 fee if postponement or cancellation happens after A-Squared Digital Media has already departed for the location. Exceptions are made for weather conditions. A-Squared Digital Media will shoot in most conditions, the real estate agent does have the option of rescheduling/canceling without a fee due to weather conditions.
Payment
A-Squared Digital Media will invoice Clients anytime after the completion of work. Client accepts that A-Squared Digital Media may make pricing corrections to the invoiced amount to reflect actual services ordered and correct use of coupon codes. Client accepts that payment of the entire invoice is due upon receipt. If payment is not received within 15 days of the date of the invoice, Client is subject to a late fee of 25% of the total on the invoice. If the invoice remains unpaid after 60 days, Client may be administered to 3rd party collection services. For returning Clients, A-Squared Digital Media will charge the entire amount of the invoice to the previously used payment method stored on file anytime after completion of services. Client agrees to A-Squared Digital Media charging the stored payment method on file upon submitting order. Payment method can be updated anytime by contacting A-Squared Digital Media. We reserve the right to attempt to collect payment multiple times if the first attempt(s) are not successful. We may also attempt alternate payment methods stored on file if one given is unsuccessful.
Service Areas
A-Squared Digital Media services the entire Phoenix Metro Area and the Tucson Metro Area. A-Squared Digital Media reserves the right to add travel charges for locations outside of these areas. If unsure, please contact A-Squared Digital Media.
